Foreword

The site in its entirety is the property of InterDrinks, whose head office is located in the Port Fluvial, 2ème Avenue, 59000 Lille, France, as are all rights related. Reproduction in whole or in part is always subject to the prior consent of the owners. However, hypertext links to the site are allowed without specific requests.


1. Acceptance of Terms

The customer acknowledges having read, at the time of ordering, the conditions of sale stated on this page and expressly accepts them unreservedly.
These general terms and conditions of sale govern the contractual relationship between InterDrinks and its client, both parties accepting them unreservedly. These general trading terms shall prevail over all other conditions contained in any other document, unless prior written consent.


2. Products

Products are offered for sale while supplies last. For the products which are not in stock in our warehouses, our offers are subject to availability from our suppliers. If the product ordered is unavailable, the client is informed within the shortest period of time through his customer account which he can access through the website and/or by email


3. Quantities

A private individual cannot simultaneously order more than 110 liters of beer. Professionals who benefit an appropriate status (eg "registered trader"), granted by the French customs, are not affected by this limitation.


4. Orders

If the customer wishes to order, he must first identify himself. In this regards, he will fill in, according to instructions provided online, a form in which he will include the information needed including full name, phone number, mailing and electronic addresses, billing and shipping addresses.
The customer having chosen the products will validate his order by clicking on the button "Confirm order" to demonstrate his commitment and acceptance of the Terms and Conditions. From that moment, the order is recorded, and an order number is communicated to the customer as well as a confirmation on the screen and / or by email. The data recorded by InterDrinks is proof of the nature, content and date of the order.
No order cancellation will be accepted without the consent of InterDrinks. Beware, if you have changed your mind, you can return the product (unopened for bottles and various boxes) within 7 days of delivery date. We will refund as soon as we receive the returned item in the required conditions. Shipping costs incurred by return of the item(s) will be under your responsibility. InterDrinks has the right to refuse or not to giving a refund for the returned items when the product packaging has been opened, the bottle uncapped or when the goods were damaged by the customer.


5. Delivery Method

Delivery is made at the address specified by the customer when placing his order. It will be carried out by Chronopost. It can only be made once the order is validated by the customer and the payment is complete. The payment centres possibly involved must give their prior agreement. If they refuse the payment, the order will be cancelled.
In addition, InterDrinks has the right to refuse any order from a customer involved in an ongoing dispute.

Delivery costs are based on package weight. These can be viewed at any time on terms of delivery.

Deliveries outside Metropolitan France are subject to specific taxes on alcoholic products (Excises) and therefore delivery addresses must be in France or in Europe but cannot be located in Andorra, Monaco or the French Overseas Department and Territories.

Delivery address: the customer agrees to indicate in its order an address to which the delivery may be made during working hours.


6. Delivery time

After preparation by the logistics department, the order is delivered within 96 hours by the carrier Chronopost or Royal Mail (Only for UK). These times are valid for working days, excluding routing problem, they are also subject to availability of products.
Under no circumstances, delivery delays due to shortage of products can lead to a refund and / or compensatory damages.
In case of shortage, the replenishment time is about 1 to 2 weeks. Delivery times start when the carrier is delivered the parcel.
In case of force majeur or exceptional events (natural disaster, epidemic, strikes, lockouts, etc…) delaying or preventing the delivery of goods, the company InterDrinks is relieved of any responsibility.
InterDrinks is in no way liable for failure to meet delivery deadlines by the carrier itself. Therefore, no compensation or refund will be granted by InterDrinks in case of delay due solely to the failure of the carrier.
Any order cancellation, regardless of the reason, and accepted by InterDrinks will give right to refund of the  paid sums only. No compensation can be requested with regards to this cancellation.


7. Price and custom terms


Your package contains a leaflet of 5 copies of your purchase invoice, stamped and signed.

The price on the product description does not include transportation costs, which are calculated according to the weight of the order.

The price listed in the order confirmation is the final price, including VAT. This price includes the price of the products, the excise taxes, the handling, the packaging, the storage of goods and transportation costs.
InterDrinks reserves the right to modify its prices at any time without prior notice. Products will be charged based on the rates in force at the time of validation by the payment of each order.


InterDrinks cannot be held responsible for any computer crash unwillingly changing the price of one or more items and / or of the order. InterDrinks reserves the right to cancel an order if the total price is not in line with prices normally fixed for the products and / or delivery charges.


8. Claims and returns

By signing the delivery receipt, the customer accepts the goods as they are. Therefore, no claim for damages suffered during transportation will be accepted. The recipient always bears the risk of the transport of the goods. Always check your package when it is delivered

. You have 48 hours after the receipt of goods to file a claim with InterDrinks in case of loss or damages.
In case of breakage, the customer is required to send pictures, either by e-mail, or by mail (Port Fluvial, 2ème Avenue - 59000 - Lille) within 48 hours upon receipt of the merchandise.
In case of a missing product, the customer must send to InterDrinks the affidavit available on our website.
The customer must check the sound condition of parcels upon delivery, and, in case of damage or loss, specify his reservations on the delivery order.
Every return of goods requires the prior consent of InterDrinks. Failing to have this consent, all returned merchandise will be held available to the customer's expense and risk, all shipping, storage, handling is the responsibility of the customer. In all cases, the return of goods is at the expense and risk of the customer.

Consumer Code Article L121-20
The consumer has a period of 7 days to exercise his right of withdrawal without giving any reasons or paying penalties, except, where applicable, the cost of return.
The period mentioned above shall run from receipt of the product.

Article L121-20-1
When the right of withdrawal is exercised, the seller shall promptly refund the customer within 30 days after the date on which this right was exercised. Beyond this delay, the amount due shall, ipso facto, product interest at the applicable rate.
The return will be followed by or registered with a declared value equal to the price of the product transported.


9. InterDrinks Insurance

The InterDrinks Insurance allows you to ensure any compensation against possible products breakage.
The client who subscribed to InterDrinks's insurance has an additional period of 7 days for all claims, or 9 days in total upon receipt of the package. In the event that:
- A product has been broken during transportation, if insurance was subscribed, then InterDrinks agrees to compensate you by sending you either a credit or a refund of the value of the product, no returns will be considered.
- In the same case but if the insurance InterDrinks was not subscribed, then the client is not entitled to any compensation, nor credit, or refund...


10. Invoicing

The customer can view his invoices on his customer account.


11. Means of Payment

Payment of an order can be made :

By credit card (Visa, Eurocard, Mastercard accepted in France)
The validation of the order by credit card equals mandate to pay the tax inclusive price of the order.
- On the Internet
With SSL, the client can safely transmit the type of card (Carte Bleue, Visa, Eurocard, Mastercard), the number of the card, expiry date and name of card holder (name listed on the credit card)
Online, InterDrinks allows you to pay via secure bank server of La Banque Populaire in a secure environment.
Your credit card number is routed to the servers of the bank, your payment is made directly to the bank in a secure environment without passing through the shop server, which guarantees even greater safety that your numbers are known only by our partner bank La Banque Populaire.

Paypal
The PayPal system allows you to pay online without sharing financial data, identifying yourself only with your email address and a password.

If the payment is not received within 15 days, the order will be canceled.

By bank transfer
To pay by bank transfer, you simply select "transfer" in our order form.
You will then send your payment within 15 days, along with your order number to enable us to identify it.
If the payment is not received within 15 days, the order is canceled.


12. Loss or theft of the package

In case of loss or theft of the package due to a problem with the carrier, it is mandatory to report it to InterDrinks within a reasonable time.
To report a lost or stolen package, the client must attach via e-mail an affidavit of non-receipt. An investigation will be opened by InterDrinks with the carrier. InterDrinks will make available to the client all information relating to the investigation. The minimum period is 3 weeks to elucidate the loss or theft of a package.
If the loss is real, after results of the investigation with the carrier, InterDrinks proceeds either to a second delivery or a refund, subject to compensation from the carrier.


13. Governing Law

This contract is subject to French law. The language of this contract is the French language. In case of dispute, only French courts will have jurisdiction.


14. Personal and private information, CNIL

Personal Information
The information and data about you are required to process your order and for communication between you and InterDrinks. This information is only passed to our necessary and essential partners, and if necessary to customs.

With regards to that, please read the file about our data management philosophy, concerning the information you entrust to us.

Preservation
This information and data are kept for at least ten years, in order to meet legal obligations, particularly when the amount of an order reaches or exceeds 120.00 euros

Declaration to CNIL
The data and information stored are subject to automated processes that have been declared to CNIL under registration number 1289144.

In accordance with the Data Protection Act of 6 January 1978; you have the right to access and rectify your personal data. You can view all your information in «My Account».

15. Protection of Minors

The law states that you must be of legal age (18 years old) to buy and consume alcohol. By using our website you stipulate that you are of age to place an order for purchases. In addition to this, the recipient must also be over 18 years old. The deliverer has the right to ask for proof of age if he doubts the recipient's legal age.
